1. Regulatory Framework
Whistler Signature provides real estate services through licensed property managers regulated by the BC Financial Services Authority (BCFSA). We comply with the Personal Information Protection Act (PIPA) and the Real Estate Services Act (RESA).
2. Our Duty of Confidentiality
As licensed professionals, our duty to you goes beyond standard data privacy. Under BCFSA rules we owe you a statutory duty of confidentiality.
We will not disclose any information concerning your affairs to any other person unless authorized by you or required by law.This duty of confidentiality survives the termination of our service agreement and continues indefinitely.
3. Collection of Information
We collect personal information necessary to fulfill our professional obligations, including:
Identification: To comply with federal Anti-Money Laundering (FINTRAC) and BCFSA "Know Your Client" requirements.Financial Data: To manage rent collection, security deposits, and financial reporting for owners.Tenant Screening: We collect references and credit history only with written consent and store them securely to prevent unauthorized access.
4. Disclosure to the Brokerage & BCFSA
Please be aware that as a licensed property manager:
Your information is shared with our Managing Broker for the purpose of regulatory supervision as required by RESA.We may be required to provide access to our records (including your personal information) to the BCFSA during a professional audit or investigation.
5. Data Retention & Security
7-Year Retention: In compliance with BCFSA record-keeping rules, all transactional and agency records are maintained for a minimum of seven years.
Secure Storage: We use high level security protection to ensure that sensitive tenant and owner data is protected against localized and cyber threats.
